Status Of Litigation Challenging Validity Of Health Reform

The US Supreme Court will hear issues relating to the 2010 health reform law in the current term that began October 2011. The Supreme Court met Nov. 10, 2011 to determine to take up the health reform issues and announced its decision November 14, 2011.

Supreme Court To Review Health Reform Law

The Supreme Court announced Nov. 14, 2011 that it will review whether Congress has the power to compel most Americans to purchase health insurance or face a tax penalty and whether the federal government’s effort to expand state Medicaid programs amounts to illegal coercion.

DC Circuit Upholds Constitutionality Of Health Care Reform Law Individual Mandate

The U.S. Court of Appeals for the District of Columbia Circuit in Seven-Sky v. Holder (D.C. Cir., Nov. 8, 2011) upheld the constitutionality of the Patient Protection and Affordable Care Act (ACA) in a 2-1 decision. The majority opinion was written by Justice Lawrence Silberman, appointed by President Reagan. Prior to his appointment as a judge, Mr. Silberman served in the Nixon, Ford, and Reagan administrations. He reportedly is a personal friend of Supreme Court Justices Scalia and Thomas and widely regarded as a very good and very conservative judge.
